1. Acceptance of Terms

By creating an account, accessing, or using LapBrain (the "Service"), which is operated by LapBrain LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

LapBrain is a motorcycle telemetry analysis platform operated by LapBrain LLC. The Service ingests your session telemetry — either from data-logger files you upload (such as AiM or MoTeC exports) or, optionally, by syncing directly from a supported connected device (such as a RaceBox GPS logger over Bluetooth) — and provides lap analysis, coaching suggestions, and performance visualizations. The Service is available via web browser and as a mobile application.

3. Safety and Assumption of Risk

Motorsport is inherently dangerous. By using LapBrain, you acknowledge and agree that:

  • The Service is informational only. All analysis, coaching suggestions, and recommendations are provided for educational and informational purposes. They are not a substitute for professional instruction, track-day coaching, or your own judgment.
  • Never operate the app while riding. Do not view, interact with, or otherwise use LapBrain while operating a motorcycle, whether on-track or on public roads. Review your data only when stationary and off the riding surface.
  • You are solely responsible for your safety. You must independently evaluate and validate the reasonableness of any suggestion, recommendation, or analysis provided by the Service before acting on it. Track conditions, weather, tire condition, rider skill, and countless other factors affect what is safe in any given moment.
  • LapBrain assumes no responsibility for your actions at a race track, on public roads, or anywhere else. Your decision to apply or disregard any information from the Service is entirely your own.
  • You assume all risk associated with motorcycle riding, track days, racing, and any activity where you choose to apply information obtained from the Service.

4. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. The Service is not available to anyone under 18, and you may not create an account for, or permit use of your account by, anyone under 18. By creating an account or using the Service, you represent that you meet this requirement.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

6. Subscriptions, Billing, and Refunds

LapBrain may offer paid features, including the LapBrain Pro Monthly subscription. Subscribing is optional, and the subscription terms shown at the point of purchase control the price, billing period, renewal timing, and any trial or introductory offer.

For mobile-app purchases, billing is handled by the app-store provider you use to subscribe, such as Apple App Store or Google Play. Your subscription automatically renews unless you cancel it through that provider before the renewal deadline shown by the provider. You can manage or cancel App Store and Google Play subscriptions through your Apple or Google account subscription settings. Deleting your LapBrain account or uninstalling the app does not cancel a provider-managed subscription.

If LapBrain later offers direct web billing, that checkout will identify LapBrain or its payment processor as the billing provider. Direct-billed subscriptions will be managed through the account page, a hosted customer portal, or by contacting us, as described at the point of purchase.

Refund requests for App Store or Google Play purchases are handled by the app-store provider under that provider's policies. LapBrain cannot issue or guarantee refunds for provider-managed purchases unless the provider makes that refund path available to us. Refunds for any future direct-billed subscriptions will be handled according to applicable law and the terms shown at checkout. If a subscription is cancelled, expires, is refunded, or is revoked, LapBrain may remove the associated paid access.

Prices may include or exclude taxes depending on your location and billing provider. If a subscription price changes, we or the billing provider will provide any notice or consent flow required by law or by the provider's platform rules. Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell, redistribute, or sublicense access to the Service
  • Upload content that infringes intellectual property rights of others
  • Interfere with or disrupt the Service or its servers

8. Your Data

  • Ownership. You retain ownership of the telemetry data you upload or sync to the Service.
  • License. By uploading or syncing data, you grant LapBrain a limited license to process, store, and analyze your data solely for the purpose of providing and improving the Service.
  • Deletion. You can delete your account and associated data at any time from within the Service (Settings → Delete Account), or by contacting us. Either way, we complete server-side deletion within 30 days.

9. Intellectual Property

The Service, including its software, design, algorithms, and documentation, is owned by LapBrain and protected by intellectual property laws. These Terms do not grant you any rights to LapBrain's intellectual property except the limited right to use the Service as described here.

AiM, MoTeC, RaceBox, and other third-party product, company, and format names referenced in the Service are trademarks of their respective owners. LapBrain is not affiliated with, endorsed by, or sponsored by them; these names are used nominatively, only to identify the data loggers and file formats the Service supports.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LapBrain does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The analysis, suggestions, or results will be accurate, complete, or reliable
  • Any defects will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAPBRAIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any action taken based on information provided by the Service
  • Unauthorized access to your data or account
  • Any other matter relating to the Service

THIS INCLUDES, WITHOUT LIMITATION, ANY INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM MOTORCYCLE RIDING, TRACK DAYS, RACING, OR ANY OTHER ACTIVITY WHERE YOU CHOOSE TO APPLY INFORMATION OBTAINED FROM THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless LapBrain and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service. Your continued use after changes are posted constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law principles.
